Grazzi lil Dr Vanni Bonello

vb1Ghal darb’ohra nirringrazzja lil Dr Giovanni Bonello li jikkonferma l-analizi li kont ghamilt jien tan-nuqqasijiet u difetti tas-sistema gudizzjarja, lura fis-sena 2011/2012. Ma jista qatt ikolli konferma aktar eccezzjonali tal-validita’ ta’ dak li kont qed nghid bhala membru Parlamentari dwar l-oqsma tal-Gustizzja u Intern, daqs kemm meta dik l-konferma tkun gejja minn persuna ta’ statura bhal ma huwa Vanni Bonello.

Franco Debono, “Vision for Justice”, Times of Malta, September 11 th 2011- “The role and powers of the Attorney General, counsel to government and chief prosecutor, should be analysed, re-examining his latitude of discretion, in certain cases without the duty to give reasons.”

Seduta 439-Parlament ta’ Malta-25 ta’ Jannar 2012-Onor.Francco Debono – “reviżjoni estensiva tar-rwol tal-Avukat Ġenerali fis-sistema legali tagħna u tal-poteri diskrezzjonali tiegħu. Fis-sistema legali tagħna l-Avukat Ġenerali huwa ftit minn kollox kullimkien. Huwa jfassal il-liġijiet, huwa prosekutur, jagħti pariri lill-Gvern, ifassal l-istess liġijiet li mbagħad huwa stess ikun parti fihom quddiem il-qrati u jieħu ħsieb l-inkjesti. Kollox ħallata ballata!”

No country for old men | Franco Debono – Maltatoday, 20th September 2011
Franco Debono is arguing for the separation between the Attorney General’s office as government counsel, and the prosecution arm. Why?   “The Attorney General is not just that. He is also involved in inquests. The truth is that our laws and judicial system many times are a mixture of aspects from various models, be they continental, British and others due to historical and other reasons.
“Sometimes they blend well and sometimes they don’t. I think even there, we must examine if there is room for reform, especially if we have full-time specialised investigative magistrates who would enjoy constitutional independence and impartiality. How would the Attorney General’s role regarding investigations fit in this scenario?”

”Not one to mince his words, Giovanni Bonello warned that the Attorney General is currently stuck in a “schizophrenic” role – at the same time government’s legal advisor and the director of the office of the prosecutor” – Dr Giovanni Bonello – Maltatoday 20th February 2016
